FEDERAL E-SIGN ACT DISCLOSURE AND AGREEMENT
This electronic transaction disclosure, consent, and agreement (collectively, the agreement) contains important information that you are entitled to receive before you consent to receive electronic records. Please read this agreement carefully and download, save and/or print a copy for your files.
This disclosure and agreement applies to all of Idaho Trust Bank’s (Bank) employees, temporary workers, contractors, and consultants. Any references to the Bank shall include its Employees, Directors, Shareholders, Clients and Affiliated Companies, including without limitation, Idaho Trust Bancorp, Idaho Trust Company, Idaho Trust Mortgage and their Employees, Directors, Shareholders and Clients.
Idaho Trust may occasionally be required by law to provide you, the signer(s) of this agreement, with certain written notices or disclosures. This agreement discloses certain information to you that we are required to provide before obtaining your consent to receive such legally required notices and disclosures by electronic means. This agreement also obtains your consent to electronically receive such legally required notices and disclosures (i.e., “required information”) in a matter that reasonably demonstrates your ability to access and retain the required information.
E-Sign Consent to Use Electronic Records and Signatures
To service your deposit, loan request or any other type of service with Idaho Trust, we want to ensure you have all of the information you need to effectively understand and manage your relationship with Idaho Trust. In deposit, loan transactions, or other services provided by Idaho Trust, you are entitled to certain information “in writing”. In order for us to satisfy those requirements with electronic documents, we are required to provide you with certain disclosures and receive your consent to proceed electronically. Before we can proceed with this deposit, loan application or service, you must review and consent to the terms outlined below.
- “We,” “us,” “our,” and “the Bank” means Idaho Trust.
- “You” and “your” means the person giving this consent, and also each additional co-borrower, co-signer, account owner, authorized signer, authorized representative, delegate, product owner and/or service user identified on any Idaho Trust product that you apply for, use or access.
- “Communications” means each application form, disclosure, notice, agreement, fee schedule, statement, record, document and other information we provide to you or that you sign or submit or agree to at our request.
- “Electronic Service” means each and every product or service we offer that you apply for, use, administer or access using the Internet, a website, email, messaging service (including SMS text messaging) and/or software applications, including applications for mobile or hand-held devices, either now or in the future.
- Your consent to use electronic records and signatures. In our sole discretion, the Communications we provide to you, or that you sign or agree to at our request, may be in electronic form (“Electronic Records”). Examples of such electronic communications include, but are not limited to:
- This ESIGN Consent Disclosure and any amendments;
- Our Online Banking Agreement, other service agreements for online access to our Electronic Services, and all amendments to any of these agreements;
- All of the periodic account and activity statements, disclosures and notices we provide to you concerning your ITB account/loan products;
- Any notice or disclosure regarding fees or assessments of any kind, including late fees, overdraft fees, over the limit fees and returned item fees;
- Notice of amendments to any of your agreements with us; and
- Other disclosures and notices that we are legally required to provide to you or choose to provide to you at our discretion.
Electronic records may be delivered to you via a secure online document platform, via secure email or via online banking messaging. In some cases, you will be able to choose whether to receive certain Communications electronically, or on paper. We will provide you with instructions on how to make those choices when they are available.
Types of Required Information Provided by Electronic Means; Accessing and Retaining Information
In conjunction with your deposit and/or loan request with us, we will provide or make required information available to you in PDF format. To access and retain required information, you will need the following:
- A personal computer/laptop or other access device, such as a tablet, mobile device or smartphone, which is capable of accessing the internet.
- An active e-mail account with an internet service provider and e-mail software.
- PDF reader: Adobe® Acrobat® Sign or similar software may be required to view and print PDF files. In order to access, view and retain electronic communications that we make available to you, you must have access to certain minimum technology requirements. You can find those technology requirements at Adobe Acrobat Sign system requirements.
- A printer (for printed copies) or a working hard drive or other storage device (to store electronic copies).
These technical requirements are subject to change. If they change, you will be provided with an updated version of this agreement outlining the hardware and software requirements, and asked to provide us with your consent in a manner that reasonably demonstrates your ability to receive notices and disclosures under the new technical requirements.
How to Obtain Paper Copies of Required Information
You may request a free paper copy of required information we have electronically provided or made available to you at any time by contacting us as set out below. Additionally, you may download and print any required information we send you through any Idaho Trust system.
Our Option to Send Paper
Your consent does not mean that we must provide the required information electronically. We may, at our option, deliver required information and other communications to you on paper should we choose to do so. We may also require that certain communications from you be delivered to us on paper at a specified address.
Withdrawing Your Consent
If, after you have consented to receive the required information electronically, you decide that you wish to receive the required information in paper format only, you may withdraw your previously provided consent by contacting us as set out below.
Informing Us of Your Current Email Address
You are responsible for providing us with a working individual email address to which we can send required information and for ensuring that it is kept current in our files. Please inform us each time you change your email address by contacting us as set out below.

Important Notice
You understand that the information you have elected to receive is confidential in nature. We are not responsible for unauthorized access by third parties to information and/or communications provided electronically nor any damages, including direct, indirect, special, incidental or consequential damages caused by any unauthorized access. We are not responsible for delays in the transmission of any information. We are not responsible for any computer virus or related problems.
Consent and Agreement
By signing below, you certify that: (i) you have read and understand this agreement, (ii) you can print on paper or electronically save this agreement for your future reference, (iii) you consent to receive the required information by the electronic means described above, (iv) you acknowledge that you are providing your consent to receive electronic communications pursuant to the Electronic Signatures in Global and National Commerce Act and intend that this statute applies to the fullest extent possible. You agree to confirm your consent electronically, as required by our procedures.

Consent and Agreement
You will be asked to acknowledge your acceptance of these terms by checking the box before you are able to continue with your application. In doing so, you are confirming that you meet the system requirements described above, that you have demonstrated your ability to receive, retain, and view electronic documents on your Access Device, and that you have an active and valid email address.
